Service Department

The documentation and legal concerns involved in a property transfer can be complex and complicated.

Resource Title’s service department is comprised of local and national account service teams. Each member of our team maintains complete control over the exam, update and filing process.

Resource Title's service department is responsible for the accurate and timely completion of title exams, converting the exam information into an easy to read and understand title commitment. The commitment allows potential Buyers, Lenders and Realtors to see the status of the real estate title at a glance without having to interpret the massive amount of documentation obtained in the actual exam. The department also supplies tax and legal reports to Realtors. This allows the Realtor to ensure they have the correct property information and parcel numbers as well as current real estate tax information. The department is instrumental in notifying the interested parties of any title clouds. If necessary they assist the Seller or Lender in clearing those clouds. They can also prepare needed documentation such as affidavits and power of attorney paperwork. They are highly experienced professionals and have the knowledge to sort through the various legal documents that make up the exam. Using this knowledge they are able to determine the course of action regarding deed preparation, trust documentation, bankruptcy, probate and any lien of record. They are also able to track the order from start to finish to keep everyone updated on the status.

The process starts with preliminary instructions from the Lender or Realtor. Order entry and request for title exam are completed using these instructions. A tax and legal report is done, if requested by the Realtor. When the exam is received, the commitment is typed. If there are title clouds, the service team begins clearing title. This process involves getting releases on prior mortgages, gathering trust information, determining true identities of property owners, obtaining divorce decrees, and documentation of bankruptcies and foreclosures among various other legal items. When the real estate is sold, the contract is received and the data is updated with the Realtor information, Buyer, Lender, sales price and closing date. The file is then forwarded to the escrow team. After close, the service department completes the final policy and forwards the original recorded documents to the appropriate parties.

The department also can order location surveys for Lenders who can do their own escrow closings, but do not issue title insurance. In addition, they provide comparables, and have internet access to many county offices to get instant answers and copies of documents. (Not all counties have a web based system)
